Agreement to Terms

CHATIFIX ("the Service") is owned and operated by Md Rezaul Karim, based in Tangail, Bangladesh. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all visitors, users, and paying customers of CHATIFIX. Please read them carefully before using our platform.

Service Description

CHATIFIX provides an AI-powered business automation platform including but not limited to: AI chat assistants, order taking, appointment booking, ticket management, CRM, email marketing, Facebook automation, voice AI, and API access. Features available depend on your subscription plan.

Account Registration

To use CHATIFIX, you must create an account with accurate and complete information. You are responsible for:

• Providing truthful and up-to-date account information.
• Maintaining the confidentiality of your account credentials and API keys.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

You must be at least 18 years old to create an account and use CHATIFIX.

Subscription & Payment

Plans

• CHATIFIX offers Free, Professional, and Enterprise subscription plans.
• A 14-day free trial is available for the Professional plan with no credit card required.
• Plan features and pricing are listed on our Pricing page and may be updated from time to time.

Payment Processing

All payments are processed by Paddle.com Market Limited ("Paddle"), our merchant of record. When you purchase a subscription, you are entering into a transaction with Paddle, who handles all billing, payment processing, sales tax, and VAT on our behalf. Paddle's Terms of Use apply to all payment transactions.

Billing Cycle

• Paid plans are billed on a recurring monthly or annual basis, depending on your selection.
• Your subscription automatically renews at the end of each billing cycle unless you cancel before the renewal date.
• Paddle will charge the payment method on file at the start of each billing period.

Price Changes

We reserve the right to change subscription pricing. Any price changes will be communicated at least 30 days in advance via email. Existing subscribers will continue at their current rate until their next renewal period after the change takes effect.

Cancellation Policy

• Cancel anytime: You may cancel your subscription at any time from your account dashboard or by contacting [email protected].
• Access until end of billing period: After cancellation, you will continue to have access to all paid features until the end of your current billing period. Your subscription will not renew.
• Downgrade to Free: After your paid subscription expires, your account will automatically downgrade to the Free plan. You will not lose your data.
• Data retention: Your data (documents, conversations, configurations) is retained for 30 days after your paid plan expires, giving you time to resubscribe or export your data.
• Re-subscribe anytime: You can upgrade back to a paid plan at any time to restore full access.

Free Trial

• New users are eligible for a 14-day free trial of the Professional plan.
• No credit card is required to start the trial.
• At the end of the trial, you can choose to subscribe to a paid plan or continue on the Free plan.
• You will not be automatically charged after the trial ends.

Fair Usage

Each plan includes specific usage limits (queries per day, documents, API keys, etc.). These limits are clearly stated on the Pricing page.

• If you exceed your plan limits, service may be temporarily restricted until the next billing cycle or until you upgrade your plan.
• We will notify you when you are approaching your usage limits.
• Abuse of the service (e.g., excessive API calls, automated scraping, or using the platform for spam) may result in account suspension.

User Obligations

When using CHATIFIX, you agree to:

• Provide accurate account information and keep it up to date.
• Use the service in compliance with all applicable laws and regulations.
• Not upload illegal, harmful, or copyrighted content without authorization.
• Not attempt to reverse-engineer, hack, or disrupt the service.
• Not use the service to send spam, phishing messages, or misleading content.
• Not share your API keys with unauthorized parties.
• Be responsible for the content your AI assistant delivers to your customers.

Account Termination

By You

You may close your account at any time by contacting [email protected]. Upon account closure, your data will be retained for 30 days and then permanently deleted.

By Us

We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Service.
• Engage in abusive, fraudulent, or illegal behavior.
• Use the service to harm others or distribute harmful content.
• Remain inactive for more than 12 months (Free plan only).

We will make reasonable efforts to notify you before suspension or termination, except in cases of severe violations.

Intellectual Property

Your Content

You retain full ownership of all documents, data, and content you upload to CHATIFIX. We do not claim any ownership rights over your content. Your data is yours — always.

Our Platform

The CHATIFIX platform, including its software, design, branding, AI technology, and all related intellectual property, is owned by CHATIFIX and protected by applicable copyright and trademark laws.

License

By uploading content to CHATIFIX, you grant us a limited license to process and index your content solely for the purpose of providing the AI assistant service to you. This license terminates when you delete your content or close your account.

Limitation of Liability

CHATIFIX is provided "as is" without warranties of any kind, express or implied. While we strive for the highest quality and uptime, we are not liable for:

• Inaccurate or incomplete AI responses.
• Service interruptions or downtime due to maintenance or unforeseen circumstances.
• Loss of data due to circumstances beyond our reasonable control.
• Any indirect, incidental, or consequential damages arising from use of the service.
• Actions taken by third-party services (Paddle, Facebook, WhatsApp, etc.).

Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes arising from these Terms or the use of CHATIFIX shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the jurisdiction of the courts of Bangladesh.

Changes to These Terms

We may update these Terms of Service from time to time. When we make significant changes, we will notify you via email or a prominent notice on our website at least 30 days before the changes take effect. Continued use of the service after changes constitutes acceptance of the updated Terms.
